Washington County Sheriff's Office says operators illegally sold more than $1.7 million worth of pot

Detectives from the Westside Interagency Narcotics Team (WIN) served a search warrant at The Human Collective, a Tigard medical marijuana dispensary, early Thursday morning.

The Washington County Sheriff's Office says the dispensary, located at 11509 SW Highway 99W, has been illegally selling marijuana.

Oregon law allows medical marijuana to be provided at cost to certified card holders, but it cannot be sold to them for a profit. The sheriff's office says the dispensary was selling marijuana at inflated prices and had over $1,700,000 in sales over the last year.

"They can have a caregiver or someone growing for them, but the person that's growing it for them can only charge them the amount that it costs to actually grow the marijuana, which is extremely small," sheriff's office spokesman Sgt. Bob Ray told KOIN Local 6 News. "When you come to a dispensary with very high prices — that are much much more than what it costs to produce — then that's against the law."

The warrant also covered the neighboring Grow America Garden Supply shop at 11511 SW Pacific Highway .

A second search warrant was served at a residence occupied by two of the dispensary's operators a few blocks from the dispensary off 63rd Avenue in Tigard. Detectives detained and questioned David Nicholson, 37, and Sarah Bennett, 36, in connection with the case. They were not arrested or charged with any crime.

Investigators seized 21 large and over 200 smaller marijuana plants at the residence. They also seized about 40 pounds of marijuana buds, over $23,000 in cash, and three firearms between the two search locations.

Two children, ages three weeks and four years old, in the house that were taken into protective custody and turned over to a family member.

This case is being forwarded to the Washington County District Attorney for grand jury consideration.

The raid comes less than six weeks before Oregonains will vote on Ballot Measure 80, which would legalize and tax marijuana.
