Commission pushes to process waivers


   Over the past month, the Jefferson County Commission and the Community Development Department have made a major push to process the deluge of Measure 37 claims filed near the Dec. 4, 2006 deadline.
   Senior planner Sandy Mathewson estimates that about half the 86 claims filed in 2006 were filed near the deadline. "We're trying to get them done before the 180th day is up," she noted.
   Under the guidelines of Measure 37, passed by Oregon voters on Dec. 4, 2004, the commission has 180 days from the filing date to process the claims.
   There were 50 claims filed in 2005, for a total of 136 filed to date. Eight were withdrawn and one was denied.
   Measure 37 allows property owners to ask local and state government for compensation when regulations reduce the value, or restrict the use, of property they owned before the regulations were passed. Government, in this case the county, has the option of waiving the regulations in lieu of compensation -- as Jefferson County has done.
   At regular meetings on Feb. 28 and March 14, as well as a special meeting March 21, the commission processed 20 waivers. The commission expects to process six more today.
   Nine waivers were granted March 21, including the following:
   . Lloyd and Rosabelle Root, of Bend, were granted a waiver to develop and divide 155 acres of exclusive farm use land into 155 lots, primarily for residential use. The Roots acquired the land in 1945, when it was not zoned. The land is located on the north side of Eureka Lane, one mile west of Metolius.
   . Duane Benson, of Culver, who acquired 153.5 acres of EFU land on Iris Lane, on the west side of Feather Drive, in 1968, requested and was granted a waiver to divide the property into five lots with a dwelling on each.
   . Roff Farms Inc., of Madras, which owns 304 acres of EFU land on Southwest Franklin Lane, on the west side of Feather Drive, was granted a waiver to divide the property into 40-acre or smaller lots, with a dwelling on each. Roff Farms acquired the property in 1975, when there was a 40-acre minimum lot size on EFU property.
   . Milton and Alice Satterlee, of Madras, were granted a waiver to divide 149 acres of EFU property into two parcels, with a dwelling on each. The Satterlees acquired the property, located on North Adams Drive, at the intersection with Hickory Lane, in 1993.
   . Robert and Helen Lundy, of Madras, who have owned 104.5 acres on the west side of Bear Drive, north of Eureka lane, since 1950, were granted a waiver to divide the property into one-acre lots, with a dwelling on each. The EFU property was not zoned when they acquired it.
   . Jeffrey and Willeta Howard, of Culver, were granted a waiver to divide 6.62 acres of residential land into two-acre lots, with a dwelling on each. The Howards acquired the property in 1991, when there was a two-acre minimum in the area on the west side of Juniper Butte. There is currently a five-acre minimum.
   . Irvin and Mary Raines, of Madras, who own 112 acres of rangeland on the east side of U.S. Highway 97 at Bear Drive, were granted a waiver to divide the property into one-acre lots for construction of dwellings. The Raines acquired the property in 1972, when it was in an agricultural district that allowed one-acre lots.
   . Michael and Brenda Kast, of Drummond, Mont., have owned 40 acres of rangeland on the west side of Jordan Road, south of Three Rivers, since 1991. They were granted a waiver to allow them to build one dwelling.
   . Fay M. Drake, of Culver, was granted a waiver to divide 84.29 acres of EFU property, located on the north side of Iris Lane, on both sides of U.S. Highway 26, into residential lots at least one acre in size. Drake acquired the property in 1958, when it was not zoned.
   At its March 14 meeting, the commission granted three waivers, and amended four previously granted waivers.
   . Sondra Braden, of Terrebonne, was received a waiver to divide 120 acres of primarily rangeland -- located on the east rim of the Crooked River, adjacent to the Deschutes County line -- into three 40-acre parcels, each with a dwelling. Braden acquired the land in 1986, when the minimum lot size was 40 acres, rather than the current 160.
   . Theodore Matylinski, of Metolius, was granted a waiver to divide 40 acres of exclusive farm use property into home sites of two to five acres. Matylinski acquired the property, located near Southwest Jericho Lane, southwest of Feather Drive, in 1973, when it was in an agricultural district, which allowed one-acre parcels.
   . Brian Stevenson, of Anchorage, Alaska, requested a waiver on 150 acres of exclusive farm use land on Northwest Fir Lane, on both sides of U.S. Highway 26. Stevenson, who acquired the property in 1980, when there was a 40-acre minimum lot size, was given a waiver to divide the property into three parcels, with a dwelling on each.
   The county approved eight Measure 37 waivers at its Feb. 28 meeting.
   . Ann Malott, of Powell Butte, was granted a waiver to built one farm dwelling on 59.25 acres of rangeland located about one-quarter mile west of Haystack Reservoir.
   When Malott acquired the property on Nov. 17, 1987, it was zoned for exclusive farm use, but no income test was required to build a dwelling.
   . Parrline Norton, of Terrebonne, who acquired 60.75 acres of EFU land about one-quarter mile west of Haystack Reservoir in January of 1985, was also granted a waiver to build one farm dwelling. Her property is currently zoned rangeland.
   . Ronald Alley, of Culver, was given a waiver to divide 40 acres of EFU property on Southwest Green Drive into two 20-acre parcels, each with a dwelling. Alley acquired the property on May 28, 1975, when such division was allowed.
   . Teresa Clark, of Madras, was granted a waiver to allow her to divide 160 acres of EFU property on the north side of Dogwood Lane into two parcels, with another dwelling on the second parcel. She acquired the property in 1991.
   . Brooke Sandahl, of Bend, who owns 40 acres on the east rim of the Crooked River, one-quarter mile south of Park Lane, was granted a waiver to build a nonfarm dwelling on rangeland. Sandahl acquired the property on June 3, 1994, when regulations allowing homes were less stringent.
   . Ida Swenwold, of Madras, received a waiver to allow development allowed in 1982, when she acquired about 38 acres of exclusive farm use property about one-half mile west of U.S. Highway 97, north of Cherry Lane. A dwelling in conjunction with farm use was allowed at the time, without an income test.
   . D.R. and Lavera Jeter, of Culver, were granted a waiver to allow them to divide 40 acres of rangeland at the western end of Southwest Park Lane into two parcels, each with a dwelling. The Jeters acquired the property in 1976, when it was in a general agriculture zone, with a 20-acre minimum lot size.
   . Arvo Rahkola, of Sammamish, Wash., who has owned 35 acres on the north side of Iris Lane, bordering Culver, was granted a waiver to divide the property into one-acre parcels, with a dwelling on each. Rahkola acquired the exclusive farm use property in 1944, when it was not zoned.
