City of Lake Oswego sued by former cop

A former Lake Oswego Police officer is suing the city, saying he was wrongfully terminated after being accused of having a drug and alcohol problem.

In a lawsuit filed in federal court last month, Brian Witt, an officer with the Lake Oswego Police from March 2001 to February 2006, said he was fired because city officials falsely believed he was an alcoholic and a drug addict.

The suit charges Witt is not disabled because of drugs or alcohol and, if disabled, his firing would have violated the Americans with Disabilities Act.

Witt wants compensation for lost wages, benefits and ongoing emotional harm. He is seeking back pay, compensatory damages and attorney fees of at least $100,000.

David Powell, city attorney for Lake Oswego, said the city has yet to be served with the suit and declined to comment at this time.
