What next? Censure, recall or state ethics investigation are all possibilities

The Troutdale City Council has not officially decided what its next steps are following the Tuesday release of an independent investigation into Mayor Jim Kight’s controversial building on his property.

The council also has not discussed what it will do about the building.

Council President Doug Daoust, who is running for mayor against Kight in November, indicated the council may vote on a second censure — or public reprimand — of Kight. The council could ask Kight to resign in the censure, but it does not have any enforcement authority.

The City Council also could release the 95-page investigation report to the public. The 18-page report currently available to the public was abridged on the advice of city attorneys.

The council also could forward the investigation to the Oregon Government Ethics Commission, a seven-member citizen commission charged with enforcing government ethics laws. When a complaint is filed, the executive director reviews it to determine if the commission should open an investigation. The commission can levy penalties that range from a letter of education to a fine of several thousand dollars per violation.

In 2011, the commission investigated former Wood Village Mayor Dave Fuller over a complaint that he failed to disclose his conflict of interest regarding the employment of his daughter with the city. The commission dismissed the complaint.

Any prospective recall petition against a city official must be filed with the city’s elections official, according to the Oregon secretary of state’s office. If the petition is approved, recall petitioners have to collect a certain number of signatures from registered voters in the city.

If enough signatures are gathered and approved by the county, the local elections official will notify the city official in question. The city official who is being recalled can either resign from office or submit a Statement of Justification form explaining his or her term in office.

If the city official does not resign, a recall election will be scheduled.
