A 71-year-old West Linn man has been charged with driving under the influence of intoxicants in an auto accident that occurred the night of July 15 on Highway 43.

Following a blood test taken at Oregon Health & Science University, James M. McQuay was cited by Lake Oswego police for DUII, reckless driving and two counts of recklessly endangering others.

McQuay is recovering from the accident at OHSU after being listed in critical condition for several days. After his condition improved sufficiently, the hospital completed a blood-alcohol test.

The accident happened at 8:47 p.m. on a Monday night. McQuay was driving toward West Linn on Highway 43 when his vehicle crossed the center line near Glenmorrie Drive and sideswiped another car. McQuay suffered severe injuries. His passenger, Verne McGough, 69, of British Columbia suffered injuries. After treatment at OHSU McGough was released. Tyler J. Anderson, 21, the driver of the other vehicle, was not injured.

The accident caused police to shut down sections of Highway 43 until 5 a.m. on July 16.
