by: MULTNOMAH COUNTY SHERIFF'S OFFICE - Robert ZachowA Southeast Portland man has been charged with unlawful use of a firearm after he fired his shotgun into the air while trying to stop three people from stealing his marijuana, Portland police said.

According to police, Robert Zachow called 9-1-1 around 4:08 a.m. Saturday, Sept. 28, to report that he had fired his shotgun outside his residence in the 13200 block of Southeast Division Street.

When officers arrived, they ordered Zachow out of his apartment with his hands in the air, police said. Zachow cooperated and had left his shotgun inside. The shotgun was seized as part of the investigation.

Zachow told police he fired his shotgun into the air at least one time after he saw a group of people in his fenced backyard trying to steal his marijuana plant, police said. Zachow told police he did not fire the shotgun at anyone during the incident.

Officers searched the area and eventually located three people riding bicycles near Southeast 129th Avenue and Powell Boulevard. Officials confirm a marijuana plant was found with the group.

Eric Presnall, 21, was arrested for on an unrelated warrant, police said. Officers learned that Presnall, and two other males, an 18- and 16-year-old, attempted to steal the plants growing in Zachow’s backyard.

The 16- and 18-year-old were released from the scene and have not been charged. Officials said the investigation is continuing and the case will be forwarded to the district attorney’s office.

Zachow was booked into the Multnomah County Detention Center.
